Man gets self back in jail
Michael Ramos, 48, was brought into Fontana Superior Court on Monday so he could be released from jail after having served the 180 days required by his plea bargain.
But rather than take his freedom, the Fontana man asked a judge for permission to back out of his deal with prosecutors.
Judge Raymond Haight set a hearing on the request for later this month and ruled that Ramos will have to stay in jail in the meantime.
"It is an unusual move on his part," Deputy District Attorney Karen Martinez said of Ramos' request.
Ramos was arrested in March when he allegedly went to a Fontana park to have sex with a 15-year-old "girl" he met on MySpace.com.
The "girl," however, was an Internet fabrication conjured up by three teenage boys, who called police when Ramos showed up at the park, according to police.
Police arrested him and he was charged with attempted lewd acts on a child and two counts of attempted child molestation.
He pleaded guilty to the felony count of attempted lewd acts on June 21 and was ordered to return to court July 26 to be sentenced.
As part of the plea, he would spend five years on probation and serve 180 days in county jail.
Ramos' jail sentence would have been complete this week on early release, and he appeared in court Monday so he could be released pending his sentencing, Martinez said.
When he told the judge he wished to withdraw the plea, the judge appointed a new attorney to represent him and scheduled a hearing on the request for July 26.
Martinez said the judge will allow Ramos to withdraw his guilty plea only if Ramos can prove he has a valid legal reason to do so.
Ramos cannot do it simply because he's had a change of heart or feels pangs of regret, the prosecutor said.
Such requests are rarely granted, she said.
